II. Origin of personal data
1. The controller processes personal data obtained with the customer's consent and collected as part of the purchase contract and execution of the electronic order made in the artcon.pt online store;
2. The controller processes only the customer's identification data and contact details necessary to fulfill the purchase contract;
3. The controller processes personal data for delivery and accounting purposes and for the necessary communication between the parties involved in the contract for the period required by law. Personal data will not be disclosed and will not be transferred to other countries.
III. What personal data do we process, for how long and for what purposes?
We will only process your personal data to the extent that it is strictly necessary to ensure the regular operation of this website, ensuring that you enjoy all its features, as well as the provision of our services, in accordance with the General Regulation on the Protection of Personal Data ("GDPR"), Law No. 58/2019, of August 8, 2019 (law that ensures the implementation, in the national legal system, of the GDPR), Directive 2002/58/EC, of July 12, 2002 (directive on the processing of personal data and the protection of privacy in the electronic communications sector), Law No. 41/2004, of August 18 (law that transposes the aforementioned Directive 2002/58/EC into the national legal system), and with other applicable legislation on privacy and personal data protection.
Your personal data will be deleted or anonymized as soon as the purposes for which they were processed cease, without prejudice to situations in which the law or legitimate reason justifies or requires their retention for longer periods.
Below, we will provide you with all the information about the processing of your personal data, in particular, the respective purposes, legal bases, categories of personal data involved and retention periods applied. We will also provide information regarding your rights in terms of personal data protection, as well as about the technical and organizational measures we adopt to guarantee your privacy.
1. The controller stores personal data for the period necessary to comply with the laws and regulations resulting from the contractual relationship between the Customer and the Controller and for a period of 3 years after the conclusion of the contractual relationship;
2. The controller must delete all personal data as soon as the personal data storage period ends.
The controller processes the customer's personal data for the following purposes:
1. Registration on the artcon.pt website in accordance with Chapter 4, Section 2 of the GDPR;
2. To execute electronic orders created by the Customer (name, address, email, telephone number);
3. To comply with laws and regulations resulting from the contractual relationship between the customer and the controller;
4. To execute the purchase contract based on the necessary personal data. The contract cannot be concluded without the personal data.
1. Creating and managing an online account
If you wish to create an online account on our website, we will process certain categories of personal data – identification data, contact details and address data – for this purpose. In your personal area, you can view and rectify the personal data provided, as well as add new personal data; you can also manage your marketing preferences, subscribe to new services and view your latest orders.
We will only process your personal data in strict compliance with the contract set out in these Terms and Conditions and for as long as you maintain an interest in having your online account active on our website. If you wish to delete it, you must request it by sending an email to info@artcon.pt (see details in point IV of this Privacy Policy). Without prejudice to the above, if you do not log in to our website for 2 (two) consecutive years, we will delete your online account by the end of that second year (deletion due to inactivity).
2. Purchase of items on www.arcon.pt (under development)
When you make purchases on this website, under the terms of the respective Service Policy, your personal data will be processed so that we can (a) present you with the range of products available; (b) issue your invoices; (c) deliver your purchases to the addresses you provide us; (d) send you service communications (e.g. order confirmation, information on stock shortages or replacement of items, as well as changes to the website); (e) guarantee our after-sales service (return and/or exchange of items); and (h) ensure, by collecting your internet protocol ("IP") address, our fraud management process, as well as the security of our website and the transactions carried out on it.
Regarding your payment details, these will be collected directly by the financial entities involved, which are responsible for the processing of such Personal Data.
Your personal data will therefore be processed to comply with legal obligations, execute contracts and legitimate interests.
With the exception of billing data, which we will have to keep for the legal period of 10 (ten) years, the remaining information will only be processed while you keep your online account active, as referred to in point 1.

3. Information and Direct Marketing Communications

If you wish to stop receiving these communications, you may do so from your online account (subscription management), send an email to info@artcon.pt (see details in point IV of this Privacy Policy), or click "unsubscribe"/"STOP SMS" in each communication. Without prejudice to the above, if your online account is deleted, we will also stop sending you these communications.
If you do not have an online account but wish to receive our newsletters by email, you may subscribe to them by giving us your consent. In this case, to stop receiving them, you can send an email to info@artcon.pt (see details in point IV of this Privacy Policy), or click "unsubscribe"/"STOP SMS" in each communication. Without prejudice to the above, if you do not open one of our newsletters for 2 (two) consecutive years, we will stop sending them (deletion due to inactivity).
4. Suggestions, compliments, complaints and requests for information:
If you need to speak to us, request information or submit complaints, suggestions or compliments, you can do so using the form we provide on this website.
In our legitimate interest in managing and responding to your requests, we will process some categories of personal data – identification data, contact details and order data – for the period necessary to regularly process your interactions.
Additionally, in compliance with DL No. 156/2005 of 15 September, we provide a Complaints Book in digital format on this website, and the information processed therein may be sent to the Competent Regulatory Authority.

7. To whom may we disclose your personal data?
Your personal data may be disclosed to partner companies (Subcontractors) whose participation is essential to ensure the regular operation of our website, as well as the provision of our services, namely IT, logistics and communications companies. Whenever these companies process your personal data, on our behalf and on our behalf, we guarantee the same level of security and privacy in said processing.
